A user who receives a copyright infringement Notification may make a counter-Notification pursuant to sections 512(g)(2) and (3) of the US Copyright Act. If you receive a copyright infringement Notification, it means that the material described in the Notification has been removed from our Services or access to the material has been restricted. Any content/ material/ data or databases you may use in relation to or through our Services is exclusively controlled by you ("Your Content"). MediaCity do not store or share Your Content or receive content from others. We don't receive, store nor we interact with Your Content. Your Content remains Your Content and you are solely responsible for it and its use.
You must be aware that when you use the Services you may have the option to share Your Content with other people, so you understand that by sharing Your Content other people may be able to, on a worldwide basis, use, save, record, reproduce, broadcast, transmit, share and display Your Content without compensating you. If you do not want others to have that ability, do not use the Services in a way that you share Your Content with others.
Be aware that when making use of the Services we don't have access to Your Content nor the ability or responsibility to control it or secure its access (at your storage location) from third parties, so you must take all necessary measures technical or else to secure Your Content.
With the Terms you agree not to infringe upon the rights of others (e.g., unauthorized sharing of copyrighted material, this including not to stream/ decode content without the explicit consent of the right owners. MediaCity cannot be held responsible for Your Content or content/ materials/ data others upload, store or share on your medium of storage (devices, computers, servers etc.) when using the our Services.
We do not in any way endorse, promote, or encourage any illegal or criminal activity. Streaming / downloading copyright content without the rights owner consent is unlawful. We highly discourage piracy and strictly advise our users to avoid it at all costs.
The Website and Services do not violate any laws through its valid use and we accept no responsibility for misuse. We do NOT host provide, archive, distribute, store, or stream media of any kind on our Website and Services. We do NOT own, control, manage, maintain, run or have any access to the servers or entity involved in telecasting/indexing media of any kind. MediaCity cannot be held responsible for any legal consequences that users might face due to their illegal streaming/downloading or other activities, infringing third-party rights. Users are advised to check their local laws regarding copyrights, and we advise our users to strictly adhere to their respective local laws.
If you violate these Terms, and in particular this Copyrights Policy, we may stop providing Services to you, revoke any Licence to use our software or we may close your MediaCity account. We may also block delivery of a communication (like email) to or from the Services to enforce these Terms or we may refuse access to your account. When investigating alleged violations of these Terms, MediaCity reserves the right to block access to Your account or inform public authorities of such allegations and provide them information relating to your account according to local laws. However, we cannot monitor the entire Services interaction and make no attempt to do so.
Some Services may allow you to access products, services, websites, links, content, material, games, skills, integrations, bots or applications from independent third parties (companies or people who aren't MediaCity) ("Third-Party Apps and Services"). Many of our Services also help you make requests to Third-Party Apps and Services or allow you to share Your Content or data through those apps or services, and you understand that by using our Services in a certain manner you are directing them to make Third-Party Apps and Services available to you or allow third-Party Apps and Services gain access to Your Content. The Third-Party Apps and Services may also allow or direct you to store Your Content or Data with the publisher, provider or operator of the Third-Party Apps and Services. The Third-Party Apps and Services may present you with a privacy policy or require you to accept their terms before you can install or use them. Any third-party terms do not modify any of these Terms. You are responsible for your dealings with third parties. MediaCity does not license any intellectual property to you as part of any Third-Party Apps and Services and is not responsible or liable to you or others for information or services provided by any Third-Party Apps and Services.
We reserve the right to modify this Policy or its terms related to the Website and Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.
